<p></p> <p><b>דף חדש</b></p><div>&lt;center&gt;<br /> [[Image:SanhedrinLogo.png]]&lt;br&gt;<br /> &lt;big&gt;סנהדרין – בית דין גדול של 71&lt;/big&gt;&lt;br&gt;<br /> בית הדין לעניני עם ומדינה בחסות הסנהדרין (פועל עצמאית)<br /> &lt;/center&gt;<br /> <br /> &lt;center&gt;הגשת התנגדות לתוכנית המתאר של הוועדה המחוזית של משרד הפנים לעיר ירושלים&lt;/center&gt;<br /> <br /> תמ&quot;מ 30/1 –מחוז ירושלים<br /> <br /> התנגדויות רעיוניות ומשפטיות לרציונל התוכנית<br /> <br /> בתוכנית המתאר המחוזית שהונחה בפני הציבור ואשר ניתן להגיש לה התנגדויות עד לתאריך 24 לאוקטובר 2008 הציגו יזמי התוכנית הנחות יסוד לגבי תוכנית המתאר של ירושלים, בירת מדינת ישראל.<br /> <br /> מתוך הנחות היסוד עולות הכוונות הבאות:<br /> <br /> א. מגמה של אפליה על בסיס פוליטי שכאילו נדרשת לטובת האוכלוסייה המכונה פלשתינית על חשבונה של האוכלוסיה היהודית והמתבטאת בפועל בתכנון לשם שינוי המאזן הדמוגרפי בין השכונות ובתוך השכונות לרבות היהודיות,<br /> <br /> ב. השארת שטחים לבניה שלטונית ערבית וממילא קידום המגמה השלטונית הנוכחית לחלק את ירושלים.<br /> <br /> --------------<br /> <br /> אנו מצביעים על הסעיפים הבאים ודורשים את הבהרתם המפורשת או/ו תיקונם ברוחו של חוק יסוד ירושלים כבירת ישראל ובירת העם היהודי<br /> <br /> 1. עמ' 2: סעיף 10: &quot;שמירה על תבניות הבניה בירושלים במיוחד באזורים רגישים ובאזורים המיועדים לשימור, בדגש על אגן החזותי של העיר העתיקה. [תבניות הבניה בעיר העתיקה אינן מאוזנות, אינן מבטאות את מעמדו המרכזי של הר הבית כמקום הקדוש לעם היהודי ואת השינויים הארכיטקטוניים, החפירות והסדרים המיוחדים של חניה לרבות תחבורה ציבורית מכל הסוגים, מקוואות, מלונות ותיירות לעולי רגל יהודיים הנאמדים לבדם בעשרה מליון בשנה].<br /> <br /> 2. שם, סעיף 11 השלמת פערי התכנון והעלאת הרמה של שירותי הציבור וכלל מרכיבי הפיתוח בשכונות מזרח העיר תוך הקטנת הפערים בינם לבין הרמה במערב העיר.<br /> אין עינינו צרה בשיפור תנאי החיים של האוכלוסייה הערבית בתחומיה, אבל אנו דוחים מכל וכל את הרעיון של אפליה שפירושו שיתוק הפיתוח היהודי והתאמתו להישגי הפיתוח הערבי. הנחה סמויה פסולה ברעיון זה הינו שפיגורה של האוכלוסיה הערבית נחשב לכשלון של המדינה ולא לתרבותה של אוכלוסיה זו. פועל יוצא מרעיון נפסד זה הוא שעל המדינה, היינו, במקרה זה, בסופו של דבר, על האוכלוסיה היהודית לשלם זאת..<br /> <br /> 3. שם, סעיף 12 דגש על שימור המורשת הבנויה בעיר[..] רכישה ע&quot;י גורמי ממשלה וציבור אחרים, סיוע בחקיקה מתאימה..[הפולמוסים שישנם סביב חצר סרגיי, הכנסיה הרוסית, הקונקלום בהר ציון והתביעות הקתוליות, קברות המלכים והתביעות הצרפתיות מאלצים מניעה של העברת בעלות או רכוש על אתרים בעלי משמעות הסטורית לידים זרות לאופיה הלאומי של המדינה..<br /> <br /> ב. בתחומי הכלכלה והחברה<br /> <br /> עמ' 4 סעיף 1 הרחבת התעסוקה בתחומי ההתמחות של העיר (השכלה גבוהה,ממשל ,ביו טכנולוגיה ורפואה]<br /> <br /> ניכרת אפליה נגד התפתחות של מסחר, מלאכה ותעשייה שאינם בתחומי ההתמחות והם אלו שיביאו פרולטריון יהודי ולאו דווקא שכבות משכילות. המדיניות המוצהרת תיפגע באיכלוסה של ירושלים ותאפשר איכלוס של יהודים משכבות סוציו אקונומיות מועדפות. &quot;ירושלים לא נתחלקה לשבטים&quot;. היינו חברה נאורה אינה יכולה למנוע מחברה יהודית עממית לשבת בירושלים על ידי הנגדה כלכלית. הביטוי אוכלוסיה חזקה עולה פעמים רבות בפרוגרמה ואין לו מקום.<br /> <br /> עמ' 5 בסעיף אמצעי המדיניות.<br /> &quot;הקמת מוסדות לשיתוף פעולה בינלאומי וישראלי פלסטיני תוך הדגשת מעמדה הגיאו - פוליטי של העיר.<br /> מאז וועדת פיל [ (1930 למנינם] שהחליטה על חלוקת ירושלים ובינאומה סיכול תוכנית זו על ידי רה&quot;מ הראשון של המדינה - דוד בן גוריון ב 1950 (למנינם) מנסים כוחות פוליטיים, שונים מבית ומחוץ, לחזור למצב של בינאום/חלוקת ירושלים בדרכים שונות בניגוד לחוק ירושלים. <br /> שיתוף פעולה עם גורמים &quot;פלשתיניים&quot; המוגדרים עדיין בחוק כארגוני טרור מופקע מן הדעת ולפי הנראה גם אינו חוקי. יש מקום לשיתוף פעולה עם אזרחי העיר הערבים על בסיס אזרחי בלבד, ירושלים הינה חוקית מושא פוליטי של העם היהודי בלבד.<br /> <br /> עמ' 6: אמצעי מדיניות: טיפוח ושימור מעמדם ומרכזיותם של המקומות הקדושים לדתות השונות כאבני יסוד של מדיניות הפיתוח והשימור של העיר. מדיניות זו תקרין על העיר העתיקה, על האגן המקיף אותה ועל רקמותיה הרבות של העיר כולה. <br /> <br /> השימוש בביטוי אגן הוא אימוץ של תפיסה פוליטית המיוחסת למר יוסי ביילין ותומכיו. אין אגן שוויוני בעיר, האגן הינו יהודי, בהצהרה זו אין משום הודעה בדבר הצורך להתנכלות למקומות המקודשים לדתות אחרות.<br /> <br /> עמ' 8 בחינת הקמתה של אוניברסיטה בינלאומית של המזרח התיכון,\ בנוסף לאוניברסיטה העברית והאוניברסיטה הערבית. <br /> <br /> תפיסה ומגמה זו היא חלק מהדחף לחזור לבינאום ירושלים. אמנם יש מקום להעביר את מוסדות האו&quot;ם לירושלים אך ורק בתנאי שהאו&quot;ם מכיר בירושלים כבירת ישראל, בירת העם היהודי. ויוכר הקשר של אמנותיו, כמו האמנה לזכיות האדם של רנה קאסן, לספר הספרים.<br /> <br /> עמוד 10 אמצעי המדיניות: הכנה של תוכנית מתאר חדשה לעיר העתיקה<br /> <br /> אנו טוענים כי התוכנית פוגעת בחוק יסוד ירושלים ולפיכך היא חסרת תוקף חוקי והיא מונחת בפני הציבור שלא כדין וכי כל עוד לא יותקנו תקנות לחוק יסוד ירושלים במגמות המצוינות אין לערוך תוכנית מתאר חדשה בירושלים ובסביבותיה העשויות להשפיע לרעה על האינטרסים הריבוניים והתרבותיים של העם היהודי.<br /> כל עוד לא תשרת התוכנית את הריבונות היהודית, בטווחים הנוכחיים וארוכי הטווח הרי דינה להגנז כבלתי ליגלית. כל מי שיפעל על פיה ישא, במשתמע, בתוצאות ובאחריות של מסירת שטחים ואינטרסים לאויב בכל עתיד נראה לעין מה שנוגד גם באופן ברור את חוקי המדינה<br /> <br /> לשם כך יש לעגן בתוכנית<br /> <br /> 1. שמירת כל איזור מרחב המקדש, הרכסים הצופים עליו וכל מה שבשטח שביניהם להר הבית לשם תכנון עיר המקדש שתיבנה במהרה בימינו. היינו בגבולות שבין רכס ארמון הנציב בדרום לאורך טיילת שרובר ומדרונותיה, הרכס מהר הזיתים והר הצופים ממזרח עד למעלה אדומים היינו כל האיזור שמתחתיו, רכס מלון המלך דוד ממערב ורכס היאט – הגבעה הצרפתית מצפון.<br /> <br /> 2. כל בניה ציבורית, רוויה נוספת או בלתי רוויה שאיננה מביאה בחשבון תוכנית מתאר מיוחדת לשם בירת ישראל בכלל ועיר המקדש בפרט כבירת העולם מכוח נביאי ישראל אינה ראויה.<br /> <br /> 3. תכנון תחבורה להסעת המונים רב מפלסית לאזור הר הבית, לכותל ולמרחב המקדש ובמידת הצורך הפקעת שטחים למימושה.<br /> <br /> 4. קביעת גבולות מטרופולין ירושלים עד צומת תפוח בצפון, צומת כרמי צור בדרום, יריחו במזרח ושפלת לוד במערב<br /> <br /> 5. תכנית שונה בענין תעשיה, ומלאכה בירושלים.<br /> <br /> 6. שמירת הריאות הירוקות במרחבים שבין השכונות ומאחוריהן בכיוון הפונה החוצה מירושלים.עד לגבולות המטרופולין כאמור.<br /> <br /> בכבוד רב&lt;br&gt;<br /> הרב דב מאיר שטיין&lt;br&gt;
